1. About The Shoutout Service

The Shoutout Service is operated by Avanti West Coast Limited ("Avanti", "we", "us" and "our"). It gives customers the opportunity to submit messages celebrating personal achievements, milestones and special occasions (each, a "Shoutout").

By submitting a Shoutout, you agree to these terms and conditions.

2. Eligibility

You must be aged 18 or over to submit a Shoutout. If you are under 18, a parent or legal guardian must submit the Shoutout on your behalf.

3. Submitting a Shoutout

Shoutouts must be submitted through the method specified by Avanti.

You must ensure that all information you provide is accurate, complete and appropriate. You must obtain the permission of each person named or otherwise identifiable in your Shoutout before submitting it.

Do not include personal information that is not necessary for the Shoutout.

4. Selection and Delivery

Submitting a Shoutout does not guarantee that it will be selected, displayed, announced or otherwise used.

All Shoutouts are subject to Avanti's review and selection. We may edit, shorten, decline, remove or decide not to use any Shoutout, without giving a reason.

We cannot guarantee that a Shoutout will be delivered on a particular train, date, time or journey, or at all. Operational, safety and customer-service announcements will always take priority. We may be unable to deliver a Shoutout because of delays, cancellations, disruption, staffing constraints, technical issues, safety requirements, operational announcements or any other circumstances affecting railway services.

Shoutouts are discretionary customer-engagement messages; they are not operational or safety-critical announcements. We may postpone, interrupt, shorten or cancel a Shoutout where this is necessary for the safe and efficient operation of railway services.

The Shoutout Service is free of charge. No compensation, refund or alternative benefit will be available if a Shoutout is not selected or delivered.

5. Acceptable Content

Shoutouts must not:

• be offensive, abusive, discriminatory, defamatory, threatening or otherwise inappropriate;
• contain political campaigning or lobbying;
• promote a product, business or service;
• be unlawful or encourage unlawful activity;
• infringe another person's intellectual-property, privacy or other rights; or
• contain anything that Avanti reasonably considers inconsistent with its brand, values or the purpose of The Shoutout Service.

6. Your Responsibility

You confirm that you have the right to submit the Shoutout and grant the permissions set out in these terms. You are responsible for the content of your Shoutout and for obtaining all necessary consents from any person referred to in it.

7. Use of Shoutouts

By submitting a Shoutout, you grant Avanti a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, display and communicate that Shoutout for the purposes of operating, administering and promoting The Shoutout Service.

8. Privacy

We will process personal data submitted in connection with The Shoutout Service in accordance with Avanti's Privacy Notice: Privacy Policy.

Please provide only the personal information needed for the Shoutout and ensure that you have the necessary permission to provide it.

9. Changes or Withdrawal

We may suspend, amend or withdraw The Shoutout Service at any time.

10. Liability

Nothing in these terms excludes or limits Avanti's liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

The Shoutout Service is provided free of charge and on an "as available" basis. We do not make any representation, warranty or guarantee that a Shoutout will be selected, announced, displayed, delivered, available on a particular service, or delivered without interruption, delay or error.

To the fullest extent permitted by law, Avanti excludes all liability to you for any loss or damage arising out of or in connection with The Shoutout Service or these terms, whether arising in contract, tort (including negligence), breach of statutory duty, misrepresentation, restitution or otherwise. This includes any direct, indirect or consequential loss, and any loss of enjoyment, opportunity, goodwill, reputation, anticipated saving, anticipated benefit or data.

Without limiting the paragraph above, Avanti will not be liable for any loss or damage arising from or connected with:

• a Shoutout not being selected, edited, announced, displayed, delivered, postponed, interrupted or cancelled;
• any delay, cancellation, disruption, staffing constraint, technical issue, safety requirement, operational announcement or other circumstance affecting railway services or The Shoutout Service;
• any reliance placed on the availability, timing or content of a Shoutout;
• any inaccurate, incomplete, inappropriate or unauthorised information submitted by you or another person; or
• the acts or omissions of any third party.

Nothing in these terms affects your statutory rights.

11. General

These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction over any dispute arising out of or in connection with these terms or The Shoutout Service.
