Click & Collect Food and Beverage Terms and Conditions
These are the terms which govern Avanti’s click and collect food and beverage service. Please read these terms carefully.
As an Orderbee Vendor can accept your order and make a legally enforceable agreement without further reference to you, you must read these terms and conditions to make sure that they contain all that you want and nothing that you are not happy with. If you are not sure about anything, just email us: support@orderbee.co.uk. If you do not accept these terms and conditions in full please do not use our Service.
1. Interpretation
1.1. “Avanti” or “we” means First Trenitalia West Coast Rail Limited (trading as Avanti West Coast) incorporated and registered in England and Wales with company number 10349442 whose registered office is at 8th Floor, The Point, 37 North Wharf Road, London, United Kingdom, W2 1AF;
1.2. “Order” means the User's order for Products;
1.3.“Product”means any products listed for sale by us on the Website, of the number and description as set out in the Order;
1.4. “Service” means our click and collect food and beverage service;
1.5. “Website” means clickandcollect.avantiwestcoast.co.uk operated by Avanti.
2. About these terms
2.1. These are the terms on which we provide the Services to our passengers (“you”). By using the Service, you agree to be bound by these terms and conditions.
3. Your responsibilities
3.1. You must only use the Service on a device and payment method you are legally entitled to use.
3.2. We accept no responsibility for fraudulent activity that may occur on your account or via your personal device.
3.3. You are required to provide an email address and or a mobile number before your Order isfulfilled. The purpose of this is to make sure that we can fulfil our obligations to you under these terms and conditions.
3.4. If alcoholic or age-restricted products are purchased, you and any intended consumer must be over 18 and able to provide valid ID, on request. Failure to do so will result in your Order being cancelled.
3.5. It is your responsibility to check that Products ordered are suitable for consumption by yourself or others, in particular:
3.5.1 you must check for any dietary or allergen information and should check the Product description and packaging carefully. Please check the Product manufacturers website or contact us if you are not clear or need to ask for further information; and
3.5.2 if you are not certain that a Product is suitable, you should not proceed with your Order.
3.6. In addition to the above, please note that some Products are produced/handled in an environment where other allergens are present.
3.7. Caution should be taken with hot drinks, especially whilst the train is in motion.
4. Basis for use of the service
4.1. The description of the any Products does not constitute a contractual offer to sell Products.
4.2. When an Order has been made, we can reject it for any reason, which might be due to running out of stock or resources, a price or description mistake, inability to obtain your payment or other reasonable reason.
4.3. It is not possible for you to amend or cancel your Order once placed.
4.4. Refunds will be processed by us as soon as reasonably possible and when any disputes have been settled and agreed upon by both parties.
4.5. All Products and offers are subject to availability. Alternatives to the Products or refunds may be offered, where appropriate, at our discretion.
5. How we use your personal details
5.1. Your personal data will be processed in accordance with our Privacy Policy.
6. Fees and Payment
6.1. The fees (“Fees”) relate to the price of any Products at the date of the Order.
6.2. Fees and charges include VAT at the rate applicable at the time of the Order.
6.3. When you make a payment you will be referred to a secure payment page and payment will be collected from you on our behalf.
7. Service provision
7.1. We reserve the right to make changes to the Services, prices or these terms and conditions at any time without notice to you. The terms and conditions which apply to your Order are the terms and conditions published on the Website at the time you place your Order.
7.2. Although Product information is regularly updated, we are unable to accept liability for any incorrect information on the Website.
7.3. We have described all Products on the Website as accurately as possible. As we deal in food, it is possible actual goods may vary slightly, in style and taste although we will endeavour to keep all items as uniform as possible.
7.4. These terms and conditions do not affect your statutory rights.
8. Termination
8.1. The Contract continues up to the point you collect the Products.
8.2. We may terminate the contract or suspend your use of the Service without any notice but only where we believe you have breached these terms and conditions.
8.3. On expiry or termination of this contract for any reason, any of our respective remaining rights and liabilities will not be affected.
9.Governing law, jurisdiction and complaints
9.1. The Contract (including any non-contractual matters) is governed by the law of England and Wales.
9.2. Disputes can be submitted to the jurisdiction of the courts of England and Wales or, where you live in Scotland, in the courts of either Scotland or England and Wales.
